ASSET PROTECTION TRUST

In general terms all trusts by its nature are a vehicle to protect assets from different contingencies.
Wyoming has additional advantages for asset protection trust, among others a Wyoming trust benefits from political stability, rule of law and legal certainty.
Particularly, a Wyoming trust can benefit from confidentiality and special statutory asset protection if the trustee is a Wyoming resident regulated financial institution.



The following features must be present:


  • The trust instrument must expressly provide that it meets the conditions required by an asset protection trust under Wyoming Statutes.
  • The trust must include specific spendthrift wording.
  • The trust must be governed under Wyoming law.
  • Constitution of the trust must not contravene the Wyoming Uniform Fraudulent Transfers Act.

And the following features are strongly suggested to enhance asset protection:

  • The trust should be irrevocable.
  • If the settlor reserves certain powers, then anti-duress provisions should be included in the trust instrument.
  • The trust instrument should contain changes of situs provisions.
  • Trustee should hold discretionary dispositive powers over principal and income of the trust.
  • Though the trust assets need not be located in Wyoming, special consideration should be given to the location and nature of the trust assets held on trust.
  • Use of a protector.
